Terms of Service

1. What Visafold is

Visafold (“we”, “us”) provides an online workspace that helps Australian visa applicants organise documents, track deadlines, save pathway research, and view general information about possible visa pathways based on public Home Affairs information. We are an information and organisation tool, not a migration agent, immigration adviser, legal adviser, or application preparation service.

Visafold is a registered business name (ASIC). ABN 25 307 024 751. Operated by Louie Pelaez, sole trader, Merrylands NSW 2160 Australia.

Visafold is independent and is not affiliated with, endorsed by, or acting on behalf of the Australian Department of Home Affairs, the Office of the Migration Agents Registration Authority (OMARA), or any Australian Government agency.

Visafold is operated from Australia. By creating an account or using the service, you agree to these terms.

2. No migration advice or immigration assistance

Visafold does not provide migration advice, immigration assistance, legal advice, eligibility assessments, visa recommendations, application preparation, or representation. Nothing in the service is, or should be relied on as, advice for your specific circumstances.

Any pathway checker results, document checklists, processing times, PR pathway dates, visa criteria, or pathway information shown in Visafold is general information only. It is based on publicly available information and details entered by you, and may be incomplete, outdated, incorrect, or not applicable to your circumstances.

Visafold may display labels such as “possible match”, “criteria to review”, or “may be relevant” based on the information you enter. These labels are not eligibility outcomes, recommendations, or advice to apply for a visa.

Decisions about visa applications, employment, study, travel, finances, or legal matters are yours alone. Before making decisions, you should check the official Home Affairs website and seek advice from a registered migration agent registered with OMARA or an Australian legal practitioner. Home Affairs is the authoritative source for Australian visa information.

3. Your account

You’re responsible for keeping your password confidential and for activity on your account. Let us know immediately if you think your account has been used without your permission.

You must be at least 16 years old to use Visafold. You must not create more than one free-tier account to circumvent free-tier limits.

4. Free and Pro plans

The Free plan includes 1 application and 5 documents. The Pro plan is a one-time purchase of A$49 that removes these limits for as long as Visafold continues to support the Pro plan. Payments are processed by Stripe; we don’t store full card numbers.

Pro is a one-time purchase, not a subscription. There are no recurring charges. If we introduce paid add-ons or new optional features in the future, they may be sold separately. Your Pro access to the core Pro features available at the time of purchase will remain for as long as Visafold continues to support the Pro plan.

Refunds:if you decide Pro isn’t for you within 7 days of purchase and haven’t made substantial use of Pro-only features, email us and we’ll refund the payment. After 7 days, refunds are at our discretion.

5. Your documents

Documents you upload remain yours. We don’t claim any ownership of them. We use them only to provide the service to you, for example by storing them, scanning their expiry dates, and making them available for you to download.

You can download a complete ZIP of your documents from your settings, and you can delete your account. Account deletion removes your documents from active systems, subject to reasonable backup, legal, security, or compliance retention periods.

See our Privacy Policy for how documents and personal information are handled.

6. Acceptable use

You agree not to:

  • Upload content that isn’t yours, or content that is illegal, infringing, malicious, or harmful;
  • Use Visafold to give migration advice you aren’t legally entitled to give (e.g. impersonating a registered migration agent);
  • Attempt to access another user’s data;
  • Scrape, copy, or republish content from Visafold in ways that compete with the service;
  • Interfere with the security or normal operation of the service.

We may suspend or terminate accounts that breach these rules.

7. Commercial and agent use

Visafold may be used commercially. In particular, registered migration agents and Australian immigration lawyers (“Agents”) may use Visafold on behalf of their clients, including under future agent-tier plans.

When you use Visafold as an Agent:

  • You remain solely responsible for your professional advice, legal obligations, and any obligations under the Code of Conduct for registered migration agents or relevant professional rules. Visafold organises information; it does not give advice.
  • You must have your client’s authority to upload and manage their documents inside Visafold.
  • You are responsible for your own record-keeping obligations. Visafold provides tools to help with organisation, but you remain the responsible party.
  • Where a client uses Visafold directly and grants you access, the client retains ownership of their documents and data, and may revoke your access at any time.

8. Service availability

We try to keep Visafold available and accurate, but we don’t promise uninterrupted service. We may add, change, or remove features at any time. If we make a material change to the terms, we’ll let registered users know by email.

9. Liability

To the extent permitted by Australian law, Visafold is provided “as is” without warranties of any kind. We do not guarantee that visa information, criteria, processing times, document requirements, pathway information, or pathway checker results are complete, current, accurate, or error-free.

We are not liable for indirect, consequential, or special damages, or for losses arising from your visa application outcome, reliance on pathway information, missed deadlines, document issues, or decisions you make using information in Visafold.

For users in Australia, nothing in these terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute will be resolved in the courts of New South Wales.
